I'm married and I want to move back to MN. We have been living here in TX for 8 years. I have kids and want to take thwm with me. Husband dont want to move. Can I still go with out anything happening to me. There is so much more to the story. Its in the kids best intrest.

You don't mention divorce...but sounds probable...if you just tell your husband your taking kids and moving back, and you can stay or come and he say I am staying...go...but if legal separation and divorce are the next move...you can't take the kids unless its agreed upon and in writing on separation/divorce documents.

Well, at the time my ex husband and I were only seperated, there was an incedent (we live in Texas too) where my ex didn't want to return my son to me after the weekend, and he was making threats that he wasn't going to give him back and he was going to take him to France (that's where he's from) and I called the police, and they told me that as long as I did not have a divorce decree stating that I had full custody, there was nothing they could do. He was the child's father and he had every right to be with him as I did.
So, I don't think it would be a problem if you left with the kids. He doesn't have anything in writing saying he has full custody by law, so the police wouldn't be able to do anything to you.

Are you wanting to go without your husband? Are the kids in danger? Do what i did and go to court and file for custody. There is a spot that asks if you are wanting to move. The court will make an appointment to see a mediator. Bring all evidence you have. My mediator said document, document, and document. You cannot legally take the children out of state with out a court order. The husband could get you arrested for kidnapping. You are still married so therefore, you have joint custody. Your best bet is to CONSULT A LAWYER.

Legaly, it is not possible but you can move silently without much noise out of state.
