The moon orbits the earth at a different speed to the rate at which the earth spins on its axis. The earth rotates at approximately 1 rotation every 24 hours, while the moon takes about 27 days to complete 1 orbit.
How high in the sky you observe the moon depends on the relationship between the part of the earth your on and the portion of its orbit the moon is at. This is the same principal that determines how high in the sky you observe the sun to be.
As the night progresses, the part of the earth you're on "passes under" the position of the moon (because the moon is orbiting the earth slower than the earth is rotating). You see this as the moon moving across the sky, rising and setting. When this happens depends on the time of month and time of year.

Because when the moon is already in the sky before the sun the sun is in the lead of setting as the Earth spins.
The Earth rotates by 1 day on axis, the moon rotates by 0 and orbits us by 1 month and 1 year is taken for us to revolve around the sun.
