I am making shirts and I ;was wondering do I have to get it trademarked?so noone else can copy it

Clothes can't really be trademarked - only the name under which they are sold. For free advice on trademarks try your local Small Business Development Center. These centers are a program of the U.S. Small Business Administration and provide a lot of services at no cost. You've got a couple of issues here; let's tackle them one at a time.

Copyrights:

You may be able to copyright any original patterns you came up with - however, if it's just a tshirt that you're putting your name and/or logo on, then you won't be able to obtain a copyright. If you have something unique & original, I'd recommend contacting a copyright attorney to be on the safe side.

Trademarks:

Trademarks can be names of products or services, logos, slogans, packaging and even sounds and smells. In essence, a trademark can be almost anything that is used to identify a particular product or service. Registering a trademark grants the owner exclusive rights to the mark within the specified industry.

Of course, it's necessary to research the mark comprehensively prior to filing to ensure that there is no possibility of infringing upon another party.

you'd have to (a) fill out an app and send copies of your ideas with the app to the US patent office.

patent is for a type of something...I don't think you can patent clothes.....trademark is for names of companies....i.e. toyota and their emblem are trademarked
