Talk to an attorney. Since you already have court ordered visitation, it should be possible to be granted temporary custody as well, but it may be left to the mother's discretion.

Good luck!

I am sure you can try.The best thing for you to do is to go to the courts and ask to speak to a judge due to an "emergency"situation. If you already have been deemed "fit"enough to have visitation, then temp.custody will hopefully be easy.Go to the Juvenile and Domestic Relations court, where the kids reside, and speak to someone RIGHT away.I hope for the best for you and the kids.I would also like to commend you on stepping up and looking out for the best interest of your grandkids.I know you are in a akward situation, being your son in jail, having raised your own,but your grandkids will grow up better as adults because of your kind hearts.Good luck and I will be praying for you!!!

If Father has no custody, and has not paid child support, she may be able to give custody to whomever she wants. I do believe by law, the court will provide him some documentation. Your Grand parental visitation may be affected though. I would consult a lawyer, not here.
