A freind of mine who lives here in Germany just recieved a message on his cell phone from his X-wife, they were never married, but she fled to the USA, Chicago today with hiis 2 sons 2 and 4 years old, to be with her new husband an American and I think a Soldier as well. It was all I could do to keep him from destroying something, I promised to do whatever I could as an American Citizen to help him... I know He really loves his children and it broke my heart to see him in such a state... Any suggestions, should he go to and american consulate, to the german government? Any special agencies? I have already told him to get a lawyer. He is affraid he will never see them again.

They were suposed to be going on a family vacation to visit her mother, than she called and said she was never coming back

Did they have a sour relationship before she migrate? Let's wait and see if she will call again or let the children speak with him. At least, she texted him after she arrived. Not that it is right to leave with the children without his knowledge but at least, she still let him know where the kids are now. In the event that he hasn't heard from her again, he could file a missing report and she could be charged for kidnapping. Start at the local police station in Germany, and before you know it, the information already transmitted. Hopefully he has pictures of all three. Germany police will contact immigration, and will link to the American authorities. Good Luck!

All I can say is that I can imagine exactly what he is going through and what is going through his mind because I have a two year old girl and a eight year old girl and I would die if I was to ever lose them. So I will pray for him and I wish him the Best Of Luck and God will be over his shoulder all the time. And yes he need's to go and speak to an lawyer as soon as possible but it will cost but when it comes to your children it doesn't matter because there is no price on that. And I know he feel's lost but them children know's their daddy because theyre are at the age that they know. And like I said I will pray for him.

He should definitely seek some sort of government assistance. I'm not sure if the States or or the German, but he needs to take action right away file a kidnapping suit, he should tell the official everything he knows to date without omitting anything the smallest piece of information could be vital.

If he can't reach his Common-Law Spouse or if she's purposely ignoring him than he should go to the American Consulate with a Family Law pratice Attoney. But if this is him guessing what happened and he doesn't actually know that occured for sure! then contact the Police to see if they can find his spouse and children because something could of happened and they should be out as "MISSING PERSONS" you know?

i would go to the German government first as they are citizens of Germany see if he can get help there .. the fact that now she is legally married to a US citizen the American consulate should be involved.. it might even take going to the police first to file kidnapping charges against his ex.. being that your friend and her were not legally married it would be best to bring a lawyer where he decides to go..
I'll keep your friend and his children in my prayers and i hope everything works out for him!!!

If he finds a good lawyer, he/she will tell him the best course of action to follow. Where do the children have citizenship? What about custody or visitation rights from a court? He definitely needs to get someone that knows the ropes of the governments child custody laws. I wish him *lots* of luck!!!

You said they were never married so I hope your friend is on his children's birth certificates as there father or he is going to first have to prove they are his children. In either case if she has fled the country he needs to hire a private detective to find his children and a lawyer to find out his rights. As the kids have been born in Germany they are germans, so he should contact the German Embassy of the state where his X is located. They will contact US police and have the kids sent back home.

hmm... is your friend an American citizen? If so, he may have more legal ground (possibly)

Also - if they were never married, does he have custody of his kids (joint or otherwise?) that could make a difference. If so, he should make a call to the family court advocate in charge of his case - for more info.

Document EVERYTHING!!!!

first of all, how could she be x-wife if never married, i dont understand. secondly, if the German govt made her the rightful gaurdian to these kids, then there is nothing he can do about it. that is, if the german laws are the same as in USA. sorry. hope that I am wrong and there is something that can be done about it. good luck!!
