I have two new neighbors who recently moved into the apartment below me. Our patios are stacked on top of each other. I have no problem with them actually smoking, but when they smoke outside, it drifts up through my patio and into my open window. THey keep their patio door shut to keep smoke from getting into their house, yet it all comes into mine. They are nice people, and I don't want to start some sort of feud. How do I approach them about not smoking outside . . . I mean its outside?

If there is a car that ever runs within a mile of your house, its pollution will do more damage to your health than the smoke from his cigar. A 4 cylinder car produces more carcinogenic pollution in 30 minutes of idling than smoking 5,000 cigars. So yea. I smoke outside, I don't want my partner and child exposed to that smoke, and I don't want to do property damage to my apartment and belongings from extensive indoor smoking. I do it more than 20 ft. away from doors and windows to be polite, but what you are suggesting is flat out rude. Shutting your windows for an hour while the dude pushes one through is not an unreasonable sacrifice to make as a neighbor, considering you are thinking of demanding he change his habits and behaviors on his property in his own time. Just as you have the right to leave your windows open, he has a right to smoke outside on his property. Oppressing others is never the right path to take when minor, temporary actions on your part can both keep the peace and eliminate any issues. By keeping your windows open, YOU are exposing YOURSELF to it, he is doing nothing but enjoying his freedom. If you want to be polite, try being polite, seeing if there is a way to put up curtains to stop the smoke drifting in while keeping your windows open, see if there is another part of his property he can smoke on that won't bother you, or something else of this nature that is a decent, neighborly compromise. The reason nobody here can tell you how to do what you want to do politely, is because it is a fundamental non-polite action. No wording or structure will fix that.

Well , if they are nice , I guess you could mention it. Maybe they can smoke in a different spot . The same thing happens with my neighbors but they are inconsiderate in MANY ways so I put my window fan on exhaust instead of fresh air and spray lots of Glade into it.Good Luck!

Unfortunately, there is no "easy way" of doing this!

The best thing is to approach them and make freinds with them and then, explain to them that the smoke is coming into your apartment, and distracting you and making you cough! Or, explain that you have guests that have asthma and that your smoking is bothering them and you! (Though, I doubt that it will work, even if they are reasonable people, because they think slow suicide is ok! But, personally, when some one takes that up, I think they should get a note signed from everyone they know,friends and family that it wont bother them to see them on lung machines and breathing tubes, when they get older, as thier lungs deterriorate and thier love ones and family have to witness them dying like this!!!).

They will think you are trying to "infringe" on thier rights to smoke..(commit slow suicide in my opinion).

If they are Christians, remind them that they are destroying GOD's Temple! You are to do nothing to desecrate the living temple of the LORD!

If not, then direct a fan towards them, and when you smell the smoke, TURN IT ON!!

This will be the biggest "hint", if they refuse to do anything about thier smoking.

Obviously second hand smoke DOES KILL, and the proof is in! I dont even let my kids go around anyone that smokes, because of that! And, with my asthma, its even more terrible to have to suffer through.

All you can do is knock on thier door and ask them if they can smoke out in front of thier apartment because you don't care for the smok wafting into your apartment. The worst they can say is no and you would be no worse off then you are now.

wow that's a hard spot cause you don't want to start a fight but you do need to stick up for your rights. so id go to the apartment first and tell them that your getting their smoke coming into your apartment and you feel as if you shouldn't have to close your windows because of them but that something needs to be done about this. going to the apartment mangers first will get you the respect from them for coming to them before starting a feud with the neighbors. besides its easier on you if the apartment complex takes care of it for you. if that doesn't work then id talk to the people below.

The only thing you can do is keep your windows closed you can't stop them from smoking on their patio lol

Legally I don't think you can.And they must be going on the balcony for a reason( baby,toddler.elder).Only thing you can do is close your door.Or get a single family home.What fun that should be when your neighbor's dog drops one in your yard.I'm just saying,you may have to learn to live with it.

You can not do anything about it.That's their life as long as they are paying for the rent and by the way, they are smoking outside and that's the best way.... Close the window or if you want put two cotton balls inside your nose and that's really WORKS

Close the window, buy a fan, move apartments, or start saving for a down payment on your own slice of heaven so this doesn't happen to you again. If it's not one thing, it will be another. This is apartment living, like it or not.

Ask. Nicely!! Also set the floor fan to blow the smoke away from your patio.Peace.
