When someone posts their photo to Flickr they have an option of assigning it a Creative Commons license. You can search for photos with CC licences using the advanced search feature:
http://flickr.com/search/advanced/
Of course a CC license is not a blanket license to do anything you want with a photo, so read the terms.
In addition the Flickr terms of service say you must link back to the original photo page if you're using the photo hosted on Flickr's site (vs. downloading it, and serving it yourself)
Lastly, you could always just contact the photographer directly, maybe by leaving a comment on the photo you're interested in?

no flicr has a strict copywrite policy its a good reason why alot of yahoo users will stick there photos on there cus there tagged with a code that is read and in some cases can be sued for copywrite infringement

Yeah, technically nothing is stoping you, other than copyright, but chances are they would'nt know especially since the photos probably aren't watermarked with their name or site url.
