my divorce is going on 4yrs. due to my ex's failure to produce tax returns for the last seven yrs. The judge sent us to"Binding Arbirtration"... The problem is a huge gap between the courts & arbitration. There is no one that can/will enforce the Judges last motion (including but not only home maintenance). Then why did the judge put pen to paper to finalizie his last motions? The arbitirator says we have to wait until her trial. In the meantime, I am being financially taken advantage of to my ex's delight. Why? Such a waste of tax payers money...I have a lawyer who says it is the law. How can this law be changed. Maybe it won't help my case but others who are being abused.. I was physically abused for 13 yrs. Now this!!

Seek advice from another attorney.
I don't know what state you live in, but it is unlikely that a judge's order is unenforceable until you go to arbitration.
If you aren't seeking another attorney due to financial constraints look to our local Legal Aid or Legal Clinic supported by students from a local Law School.
You need to seek further advice from someone in your jurisdiction before settling for this type of treatment.
The judges order IS enforceable in every jurisdiction I know of.
And you husband should have to pay for the years he has been ignoring it.
Do yourself a favor- find legal aid or some other resource. I think your attorney may be advising you inappropriately.

contact the judge and ask him to help since he is the one that sent you there. Explain that you would like another court date that nothing is solved and that arbitration is not doing what it takes to satisfy your needs.

You could just walk away, and change your name and start a new life. Your abusive husband will do everything he can to extend the control he has over your life.
