Child support laws do have a lot of state specifics and quirks, so I'd recommend calling the state in which you reside directly. My hunch, however, is that you'd have to show that the other parent is not providing any financial support. That would then beg the question that if this person is not providing any sort of financial support, why do you allow him/her to stay and mooch off you but then ask the state to intervene to give you support?

I'm just playing devil's advocate here, that's all. Can't imagine the pain you must be going through to be asking this question.

If you are not married and he is not providing for your child, you should be able to. It's even required in some states if you apply for other benefits like Medicaid that you file child support if you are not married. Child support is part of the Dept of revenue. Find your local ofice and give them a call to verify your states' procedure.

If the only way you can get child support from someone who lives with you is by taking them to court, then you must live in constant agony. I can't imagine living under that kind of stress. And I'm sure it's not good for your child.

why is this person living with you if you feel the need to seek child support? kick the person out if they aren't paying for half of the living expenses then file for support.

I highly doubt it, as the parent residing with you is expected to support his child without legal action.

The scenario is, can she file for child support if he's still living with them.

I doubt it.

No, it defeats the purpose of providing for the child if yall live together.
