I won an eviction because the tennant defaulted by not showing up in court. He has not lived in the residence for about the last 6 weeks and has left some furniture, clothing, and other items which prevent me from re-renting. The deadbeat of course cannot be reached. Can I move out and/or sell the furniture?

you need to have to have the sherriff post the eviction paper work first. then what you can do... or at least in my state. is itemize everything in the apartment on the move out form, type it up and then send a notice of abandoned property out, (this is done through the courts as well) you then hold the items for 8 days (charging hiim storage fees day by day of course.) if he doesnt respond to the notice of abandoned property letter then you can get rid of it at your own will . I think you only have to sell things if the worth of the stuff is over $500.00 but I could be wrong about that part.

Normally the sheriff carries out the actual eviction. Check with the court clerk where you won your case; they can explain what to do.
