My "husband" for over 15 yrs have decided to part ways; Texas says that because we lived together as husband and wife, we now must get a divorce...my partner says that I'm just being difficult and that there is no reason to have to involve lawyers/laws. I think he is saying that because that would mean it is truly going to happen and he can't continue to drag his feet...I want to save this marriage but it takes two and he's shown no effort other than not making a firm decision. Any suggestions on the legal or emotional aspect of this situation? I've finally gotten over the initial shock of seperation to being totally fed up with being in limbo...HELP>>>

if you have your stuff, and he has his stuff, and theyres no "our" stuff that you're gonna fight about--- just agree that its over. if you have things that youre gonna fight over who gets what, then you need to get a lawyer. i'm not sure if there are alimony laws where you are, or if you have kids together and fighting over who gets custody, but as long as its straightforward, you dont need a lawyer. of course, if you ask a lawyer, they'll tell you that you need their services.
btw--- there is still common law marriage in some states, and while it may be a legal marriage, usually as long as you agree that its over and want to move on, you can just walk away.
you just gotta do what you think you need to do.

Sorry, but there is no protection for you as there is no common law marriage in Texas or anywhere else in America.

THERE'S SOME PROTECTION IN SOME STATES FOR COMMON LAW MARRIAGE.
