Look at it like this:
Two negative words cancel each other out. So technically, "Why can't we not be sober?" means "Why can we be sober?"

We can be. Millions of alcoholics have taken the steps of Alcoholics Anonymous and stayed sober. It works when you work it!

Because in some cases people have to do drugs to function right, of all the time of doing; your body very much immune to it and need it to survive.
For smoking marijuana it is cool, because it not a drug. It only a drug if you constantly do other drugs and being that you don't have your choice but weed and they need that high ....then it a drug.

Why can't we be under the influence? It impairs judgement,reason,and good common sense to varying degees based upon the amount ingested.

Becasue you are an alcoholic. They have drugs for that now. The drugs take the fun out of drinking.

Actually it means why can't we be intoxicated. Because it would be impossible to maintain civil obedience and if you were drunk all of the time you wouldn't enjoy it.
