The first question depends on where you are, if you happen to be on vacation in the caribbean or any other place outside the US with weak laws or law enforcement then its legal unfortunately you probably reside in the US so I would be cautious. I am a firm believer in going against the music and movie companies and think sharing stuff you bought is alright but they dont think so.
As far as the second question goes I am not sure if it is legal or not, i dont think so. But I do know this the various industries will not try to go after people who download music/videos but rather only people who upload music or videos. So download all you want just dont share your own files or you put yourself at risk of being sued, and again if you are staying at a hotel on vacation where they have wireless this is a good time to catch up on downloading the hottest music titles and fighting the system.

I would probably say NO. Since it is already pirated. I guess it would be up to your server though. I don't think I would take the chance. Its kind of like putting evidence out in the open for anyone to see.
