In California criminal law, it would depend on the intent of the assault, the priors for violent felonies and if something other than his hands were used. You mention that he already has one felony and that he should have had more. Assault with a deadly weapon would be different than domestic assault. If the intent was to do grievous bodily harm it would be different than if it was a domestic spat gone out of control. Either way, the sentence could be quite variable depending on the judge and the facts presented at court. If this were a third strike, two prior felonies, then he would get an automatic 25 to life. As is, I think your previous respondent stating 10-15 is probably pretty close. However, my experience tells me that he would probably get less than 5 years.

probably five years, with the time from the first probation added on. then i hope that all the men in prison gang up an him and beat the crap out of him. and why was the woman crazy enough to keep going back and then not pressing charges? Theft of a person? isnt that normally called KIDNAPPING?

im sorry i cant answer that question in legal terms, but ill go ahead and tell you what i'd do. First id break his nose. Second id hold him up by the back of his head and make him apologize to her. Third, id let her kick him in the nuts. Fourth, it wouldnt be pretty, but id chop his balls off and feed them to him. I know it may sound harsh, but to me, thats the only way to deal with a low life that hits a girl
