no police report because they took forever to arrive. don't have money to sue. no witnesses. i told his ins.co. (state farm) he lied & was told it didn't matter. the old man said we both backed out at the same time; but the truth is i looked & he didn't.

You make sure you tell the truth . If you have another witness get them to write a stament and notorize it. Was there police report? I f so use that to prove what happened. Also if you tell the insurance company what happened and that the other person lied they will investigate and take care of whatever needs to be done from there end. It is hard when one party lies and you have no third party witness. I know My truck was hit last fall and the driver of the other vehichile has lied for fear of losing his job. I had to hire an attorney. Two of my children were sitting and waiting for me and got injured. It is no fun. Be honest and good luck.

Was a police report done? If it was then get a copy of it, if it wasn't then unless you have a witness there probably is nothing you can do about it. You may check the area where the accident occurred to see if there are any businesses with cameras. Before you can sue you will need tangible evidence to support your claim, without it, it will simply come down to it's your word against there's which hardly ever stands up in court. The best thing to do if that is the case is allow your insurance to fix your car then let the Insurance Company go to court and handle the suit against the other party.

If you can prove them wrong, then the other party has done what is called an insrance fraud or scam. Report this to the police with any evidence you have and contact the insurance company too. Their representataives will take over from there.
Make sure you have all your documents such as the police report with you and make and save your copies. There may be a good chance that you will be summoned to court.

If you got paid for it, Id leave it be.. if you didnt get paid then sue, if they lied you can also report them to the insurance company they all have fraud divisions, and they will listen to you.,

Just tell the truth. The insurance company investigates accidents and will be able to tell if the person was lying. Although it does depend on what they lie about...

Photos and a police report will do all the talking for you. Without these, you'll have to chalk it up to experience and the learning curve.

if you had proof...like a third-party witness, not in your car, you can sue them in civil court
