Well if the speed limit is 55 and the officer clocked you doing 68 you were speeding. Just because you slowed down to pass someone doesn't mean anything. You were clocked by the cop doing 68.

In Texas the speed limit is a recommended maximum speed. Meaning you can try to use the defense that the speed you were going was safe under the particular circumstances. However it can be a hard sell.
In Texas your choices are:
Pay the ticket
Plead No Contest and Take defensive driving - ticket will not go on your record if it is the first in 2 years.
Try to fight it yourself - IE go to court
Hire a $75 traffic lawyer and have them help you fight it.
If you fight it you can do a few things:
The policeman doesn't show up to court, case is dismissed, you are off free
Goes to court everyone is there, you argue and let the Jury decide.
You can plea bargain for deffered adjudication... This is a double whammy approach. you are off free as long as you donot get another ticket within 1 year. If you do get another ticket within one year you get whacked with both tickets.
Laws and options are different per state... the above are based on Texas.
By the way the reason the law in Texas is worded that it is recommended speed is NOT so you can go faster, but instead such that under BAD conditions you should be going slower and CAN get a ticket, even if you are not exceeding the posted limit. IE horrible blinding rain that prevents you from seeing you could get a ticket for going 55 in a 55 zone, because the conditions make 55mph unsafe. The cop will say in this case that the maximim safe speed was 35 or something. (I have never heard of this actually happening, but that is the intent)
Note2: by the other responses in this thread if they were on your jury and it went to trial you would loose. But I would vote for you.. It is far SAFER to pass someone quickly than leave your car in the passing lane for to long and endanger both drivers...

Take your case to the judge. Tell what you did and that you had no intentions of speeding, the vehicle was going below safe speed limit and you had to over take the slower vehicle, But 68 in a 55. 13 miles over the posted limit. and 21 MPH faster then the so called slower vehicle, wow If this is your first time, let it be your last time speeding. Pay the fine and slow down.
Remember Speed Kills. And tell your husband, start hiding stuff now, it'll just get easier as time goes on.

you better tell your husband because the insurance companies out of random might pull your trafic record violations directly if you end up been convicted that wont be good. In any case if the speed limit is 55 you can only pass if is safe to do so at a maximum of 55 there is nothing that says how slow you can be traveling so your defense of the other car been slow is out. I don't think that type of speeding ticket affects your insurance but in any case should check with someone obiously your insurance company would be a good start but I wouldn identefy my self if I were you because insurance companies are out to make money and if it was something that they wouldn't even en up knowing if you identify your self now they have a reason to hike up your insurance rates.

If the zone is marked 55, that's as fast as you're allowed to go under the law. You probably could have gotten away with 58-59, but once you hit 60 and above, you were fair game for a ticket.

The speed limit is 55. Which means it was illegal for you to pass doing any speed over that. Sorry, you'll have to pay the ticket.

well the legal speed is 55 mph if that's the speed limit.
You don't get "Extra speed" to pass, you have to go no more than the speed limit, unless you want a ticket.
