I am speeking in terms of an accident of similar circumstances such as an auto accident or an accident at a place of work,cut finger, broken bone ect,The one who dose not test positive gets all the benefits while the other guy loses everything?

sorry for the modification,but lets say a positive test for THC which the use could have been two weeks prior to the accident. why then should the outcomes of identical accidents be worse for one than the other?

appeal it. here in georgia, they can no longer give you a piss test for a dwi, because it can take up to six weeks to leave your system. they now do a blood test, which goes back 2 days. some places use a litmus paper like test, which can detect it up to one hour after smoking. they are considered more reliable than urine tests.

There are a lot of specifics that you didn't mention, such as the type of drugs, the amount found in their system, etc.

All of these additional details play an important role. Obviously, the reason for the difference is that a drug influences your state of being and distracts your sense of focus. In many cases, it can make an "accident" more likely to happen.

Is that not obvious to you?

Basically, if you have an accident and are found to be using drugs, your employer is legally allowed to assume that your drug use was the cause of the accident, and can call it your fault. If you're clean, then it's likely considered an accident and all the workers compensation and such follows.

Because drugs can affect your judgment, and your ability to perform your duties correctly and *Safely*. This is the main reason. If the benefits of insurance are more important to you than using drugs, don't use drugs and drive.

Of course, I think they need a better drug test. The pee tests are about 50% accurate. Blood tests are better but still not perfect. The chronograph ones are the best, but dastardly expensive.

I think the point is that they don't want you to use drugs.
