I am in the middle of a divorce and my ex-wife refuses to sign the divorce papers unless I give her visitation. She claims she has rights to my kids. My story is that she only lived with the kids for six months but when we got married the kids called her mommy. I have full custody of my two kids and I seeked guidence from their biological mother and she agrees with my decision. Additionally my ex-wife lives in a different state and has been in and out of the kids lives for about two years now.

NO! Unless the kid is old enough to make his or her decisions (12 or 13) Then ask them!

i think you should go to court now and make sure she doesnt get custody of these kids, she was only in these kids lifes for a few lousy months. i think you should let the cout know of what she is doing , record every time she calls and if she is in and out of thier lifes then the judge will see that and thier is no way the judge will give her custody of these kids. these are not even her kidsshe doesnt deserve custody, she just wants them for her sick games, i think you can still get a divorce without her signature. you tried and tried but did get it cant they still do something. good luck.

No, if she's not biologically or if she hasnt adopted them then NO she has zero right to visitations with your children.. nice that she'd want to see them but theres no reason to keep up the relationship, in the end it would only cause the kids more confusion..

I think the judge will consider the fact that she was only in their lives for 6 months. Those poor children have had enough changes in their lives... don't get married again for a very long time. You owe them some stability now.

Hey a step mom has no rights at all,sure when she was married with you she had somekind of rights but nothing legal just moral.. she has nothing zip, zero, nada... not to be mean or anything but is the law really legally she has no rights for those children... good luck.

There must be a reason why you have full custody; I'm assuming abandonment, maybe drugs, prostitution? Hire a detective to dig up the current "juice" and bring HER to court to have all her parental rights severed...

Unfortunately, it is difficult to answer questions that are emotionally charged. If she is doing this just to be difficult, then no, and since she is not their biological mother and does not have any custody issues, then who cares. However, if there is an emotional tie between her and your children, they must be taken into consideration, what do they want???

I don't think she can legally do. i know that at least in florida, a step parent does not have the right for visitation or parental rights to a step chiled after a divorce.

I think that the children will be better served by your ex NOT being involved. Let her try to get visitation. It won't be a simple matter not an inexpensive one.

No --- because she didn't have a significate role in their lives and you have full custody of the kids --- their mom has visitation rights --- she don't
