I doubt it's the hotel that is the problem, but the attitude of this particular employee. Call back and talk to the owner or manager, and see what kind of response you get. He should be fired, and you should get free rooms!

In the USA, you can sue anybody for any reason. Whether age discrimination is the appropriate reason in that situation might not be the appropriate issue though. The age of the infant was not the problem. As for the competancy of the agent you spoke with, I can make no comment, as I was not privy to the actual conversation; however, a call to the hotel manager seems to be your next move.

If it is a chain hotel call the home office and explain what happened and that you are not pleased about the customer service that you received. Do it in a nice manner with a pleasant voice. They may send you a voucher to stay at one of their hotels. At the least they will contact the hotel and see that this does not happen again. It's best to do this while your child in napping. If not a chain get in touch with the better business bureau for false advertising.

I would definitely call the main number for the chain and complain. I'm not trying to be mean, but I'm on the other side of that coin, I hate being in a hotel with a crying baby. There's nothing you can do and your paying alot of money to be kept awake at night.

What's with everyone in America wanting to sue everyone? I'm pretty sure they can take whoever the hell they want and there's nothing you can do about it. Saying no because of a crying baby is pretty unfair but hey I guess that might have been a pretty classy place or something and they just like to keep all their snobby guests happy. I'm sure you'll find somewhere else.

well the only thing i would question is the families welcome thing. i once got stuck in a room that had a crying child next door, it was so frustrating i woke my teenage daughter up and drove back home in the middle of the night. i know you have little ones still so you don't get it but you can't make people pay to hear someone elses baby crying all night.

You are unlikely to be able to sue for something like that. However, note the date and time and send a letter to the hotel's corporate office about the incident. Almost certainly, they would immediately fire an employee for that.
It's very bad for business.

call back again and make reservation..with baby screaming if you like...When they tell you "not with the baby" tell them you need a faxed copy of this declination.
They may change their mind and say they are "booked"..ask for a faxed copy of that any way regardless, because you can have a friend or relative call back and ask for the same reservation day and time (get the approval) and there you have your case for discrimination...enjoy.

If I were you I would send a strongly worded (no cussing though, that makes you seem uneducated to the owners) to the hotel owners and then seek the consultation of a lawyer and take their advice on what to do.
