My boyfriend's ex-wife and his 2 children live in Killeen Texas, she wants to give him custody, because she "can't handle them on her own". We live in Florida, they (the children: ages 5 and 9) will be going to school here this year, and by the end of the school year we want to have all the legalities worked out. Since Texas has "jurisdiction" we're not sure how to handle all this. ANY help would be appreciated! Even if it's just a link to a website that could give some answers. Thanks.

Okay my husband is goin through a custody battle with his 4 year old in Texas. Since she can't "handle" her own children tell her to go to court and tell that to the judge. She is basically giving up her right as a mother, but thats in my opinion. Ask her to go to the judge and tell them she is giving custody to the father. If she wants visitation she can ask for it. But I'd ask her to get jurisdiction in Florida after she hands the children over to make it easier on you. Or wait 6 months after she gives them to the father and file in Florida.

IF she signs over custody, with the paperwork written up by an attorney (either jurisdiction, I would assume), then the State of Texas will honor it.

I live in Texas and have a son, who is 16 and old enough to chose, and he is wanting to live with his Father in Virginia.

I (and my attorney) wrote up a Temporary Custody Order (dropping my son's portion of Child Support) and allowed him to move. We will be discussing his arrangements when he comes home to visit next month. IF things are going well for him (his grades were still very good) then I will allow the Ex to have Virginia make the agreement legal and binding.

Get a local attorney, and have them link up with one in TX to handle things there. Yes, this will cost you some $$$ but it will help to ensure that everything is done properly. Good luck!
