In some states, willfull failure to pay child support is a felony. In other states, it isn't even a crime.
In all 50 states though, failure to pay child support is contempt of court. The amount in arrears before a Court will enter an order for jail varies by state to state, and even by jurisdiction within the state. Some states will jail a person for a short period, (shock time) and then monitor their case for a few months to see if they are making the child support payments they are supposed to be making. Other states have a provision that will order the offender into weekend jail, with the goal being to deny them pleasure time.
Jailing someone for an extended period of time for failure to pay child support is counter productive, however. If they are unable to work, they are unable to pay child support. A more recent movement has been work release programs, where they are incarcerated at night, but allowed out to work during the day, with almost all of their earnings taken for the child support (ongoing and arrearage)
The policies and procedures vary from state to state. You should contact an attorney in your state who works with family law to find out more specifics. If you don't know an attorney, call your local or state bar association for a referral.

It depends what state you're in. If you're getting anything, be happy. My ex never misses a visit, which is good for my son, however, he hasn't paid a penny in child support in over 5 months. I will be filing bankruptcy thanks to him. He hasn't paid any of the bills he agreed to in the divorce agreement. Because my name is on them, I'm responsible too; it doesn't matter what the divorce decree says. The bills were acquired during the marriage.
I am the custodial parent and my son lives with me. I asked my ex for my son's bike (he's 4 yr old) so we could go for a bike ride and he refused to give it to me because he's "had to replace many things and I won't share his toys (my son's) with him, and if I want to go for a bike ride with him, I need to buy him another bike". We bought our son the bike when we were still married. He reasoning for not paying child support is because he had to buy my son some toys??
My ex is $3,000 behind. There won't be a hearing for non-payment until OCTOBER 13. He won't go to jail unless he breaks the payment agreement that will be made at that hearing. They don't arrest them - they issue a warrant to turn themselves in. But what happens if I tell him he can't see his son? He will have the police at my house and I will have to let my son go with him. I don't want my son to see this so I continue to let the jerk have visitation.
Even if he never pays, I have the satisfaction of knowing, I've played by the rules, I never talk badly about him in front of my son and I will not lower myself to play his games. Hang in there. We women are much stronger than men. This is a perfect example of what a weak piece of crap my ex is and how strong I am. I won't put my son in the middle, but he thinks nothing of it. It's only to get back at me. But who is it hurting? The person my ex loves the most, his son. He's too stupid to figure that one out.

i dunno, but keep in mind your ex won't earn any money while in jail, and may lose their job, etc. but good luck getting your money, im the kid of a deadbeat
