My boyfriend just got evicted from his apartment because they said they never got his rent from June. They told him he had 24 hours to get all of his stuff out of the apartment. Is this legal? I thought you get like 30 days not 24 hours? Help!

They just knocked on his door, told him to get out and that they were changes his locks today! Is this legal??

He's lying to you. He didn't just get evicted by them knocking on the door and telling him he had 24 hours to get all of his stuff out. Where I work this is how it's done. Rent is due on the 1st and late after the 5th. Once the rent is late we send out late notices. A week later if rent is still not received we send out eviction notices saying rent must be paid by ____ day or eviction will be filed. We call in the eviction and get a court date that is usually a week out. Go to court, get granted the eviction and judgment for past due rent and court costs. The tenant is then sent a notice that the eviction was granted. They have 10 days from that date to get out or we file a writ. On that 10th day we go to the court house again and file the writ and that's usually another 2 weeks out. Total, your boyfriend has a little over a month to vacate the premises before he gets thrown on the streets. There's more to this then what he's telling you.

First in general unless this is some type of boarding house, only the sheriff under a court order may evict someone no landlord may do a eviction or change the locks this is called self help and is illegal, if they have locked him out of his apartment then call the cops and a lock smith and enter the unit, in any cases even if verbal lease it would be month to month and the landlord must give month notice to end lease

Sounds like you haven't heard the whole story. When did he get the notice of eviction? Does he have a lease?

They usually send a cop over to serve court papers and then you go to court at the said date and then from there you either pay or if not then you have 10 days to get out.

He's not getting evicted for not paying his rent in June. January, maybe, but not June.

How much money did he ask you for?

If he had a lease, he has 30 days. Without a lease he is out of luck. Does he have a cancelled check to prove that he paid?

That is not legal where I live but where does your bf live. There are all kinds of links on the net that advise legal rights for renters for just about any country, province, and/or state.
