Like I said my ex rarely comes and sees his kids and I would love to have his rights taken away, any help would be appreciated.

Unless you can convince him to give up his rights, it will be more difficult, but not impossible. He would need to have a period of not seeing the kids and having no contact what-so-ever before the court would agree to terminate his parental rights. The exact length of time would depend upon the state where the original child custody and support order was issued, unless the jurisdiction has been changed in court.

Does he pay child support? If so, many courts will look at his paying of support as contact, even if he doesn't see the kids.

If he owes you child support arrears because he hasn't paid, you can offer to forgive those arrears if he would sign away his parental rights.

One last thing: Most courts will not agree to allowing parental rights to be terminated unless there is someone else willing to adopt the children in place of the parent who is losing his rights. Have you remarried, and is your new husband willing to adopt the children? Usually you would need to have been married to the prospective adoptive parent for a period of at least one year.

Your new husband then would become the legal father of the children, and will be considered in all ways to be their father.

You may need to seek not only legal advice but a therapist too. Some parents only keep ties to a child or ex to be in control or possessive. Particularly men want to have the last say so when it comes to children that are there's. Others only want to see the ex suffer from not being permitted to move on with there lives. Seek counseling.

Why? Are you willing to tell your children one day that you enforced, encouraged their father to give up his parental rights as to being their father? Are you willing to risk their hurt and their pain? He may not be around as much as "you" or they would like but regardless the situation he is still their father. Unless, there is proof or past actions that constitute this kind of thing, ie abuse to you and/or the kids, child molester, would endanger their life or their well-being-why would you want to do this to your children? They will always love him. (if he isn't the type of person I described) If his only problem is not being around enough and you encourage him with giving up his rights, your children may hold this against you later on in life and it may come back to bite you. Is it really worth it?

Unless he is physically hurting your children, why would you want to stop his legal rights? I can understand your being angry because he doesn't see his children, but he should still have the right available to him. Your children may be upset with you, too, if you stop his rights.

You can't make your ex do anything, especially relinquish parental rights. Not unless you want him to be taking you to court for doing so and you winding up having to pay for it all.

You sound like you want to use the children as a weapon. If he does not care then he cannot be interfering with you on decisions.

You just sound pissed and should consider going to counseling to get over your anger.

You can't usually have them give up rights unless someone else is willing to adopt them.
