We divorced, small problem with him harrassing me, now he has filed court papers for visitation. My son is 3.

If he has been in the child's life and cares for him and was once a father figure why shouldn't he visit his step son ?

How wonderful that your son's step father loves him and wants to see him. But the part about him harrassing you raises red flags for me.

To answer your question, Yes, a stepfather should be allowed visitation rights IF he has been a father to the child and has been a part of the child's life for a significant number of years.

The courts will ask you for documention of the harassing claims- so be prepared. The courts may also see no just reasoning for his visitation, but also keep an open mind to them favoring him the right--if he supports you and your child in any way, he may be granted visitation rights.

Consult a child custody expert. I know this isn't custody but that's also the person knowledgeable about visitation practices.

If there was no adoption, he has no rights to visitation. This is the reason step parents adopt - to gain rights as a parent.

Legally he has no rights to the child. If you allow hi to see the child thats another thing, but if he asks the judge and you decline then no.

Whats wrong with that? is he connected with your son? he is a role model. if you can get over the anger of whatever happened to cause the break consider your kid above yourself.
