I was thinking, porn is nothing more than prostitution, granted they have health screenings and clean environment, but non the less it's prostitution. What do men and women do in porn movies, they have sex and they get paid, what do prostitutes do, have sex and get paid. So why is pornography not illegal and prostitution is? Don't include the health facts because i already mentioned them. Is it because porn industries pay taxes, so the politicians are getting paid and prostitution doesn't pay taxes so the politicians don't get paid. If prostitution had health screenings and a more controlled environment, would it then be legal, specially if the pimps paid taxes on their HO's?

Well then what if the prostitute is expressing her right to art by showing the men things they never experienced before? She is making art.

See US constitution, amendment # 1.
The courts have ruled that obsene speech is semi- protected, which means that it can be modified by place and time, but not by content.

The taxation thing isn't the answer. It's actually the opposite. I assume that in Nevada, prostitution is taxed.
I'm no lawyer, but I think pornography might differ from prostitution legally, in that it's a depiction of an act, rather than the act itself. A depiction is covered under the First Amendment, but an act probably isn't.
It's an interesting question, and I hope your answers aren't overrun by jackballs of either persuasion.

Pornography should be Illegal, because it's Immoral and leads to Criminal Acts, Especially Victimizing Children. It also Destroys Marriages. A line HAS to be drawn Somewhere. "This is a Very Good Question!" They are Banning Cigarettes in Public Places, because of Health Reasons. How about Banning Pornography, for Mental Health Reasons? People need to Write Congress about this(petition), if it would do any good!?

Why isn't pornography illegal. Let me tell you something. Do you know what country this is? United states of ******* America. You know what kind of country they call this? a free country. Free to Life, Liberty, and the Pursuit of hapiness, as the Declaration of Independence declares it so.
Now, we are given are freedom and liberty as much as possible without doing anything that might challenge the well being and freedom of others? Prostitution is illegal because of well being of others. Why isn't pornography illegal? Because watching it isn't hurting anybody, porn videos are shot under the best of conditions (the people are well protected, sexual transmitted diseases are tested, etc), and if pornography were illegal, I guarantee that the government would get overthrown for that very reason, because where I live, we are free. That's the U.s. of A buddy

First of all you'd be pretty hard pressed to define pornography, it's definition is based on your communities values so it's different in different parts of the world. Men and women get paid for doing porno movies (or adult movies) becasue it's acting or modeling, just another job right? Prostitution isn't illegal about 300 miles north of me in Nevada! Men have paid women since the beginning of time for sex. I imagine the first time it happened in a cave and it cost the man a hind-quarter of dino meat. lol.

Given your way of thinking, one could also say that a date should also be illegal. You take a girl out, pay for a movie, dinner, and what not and if you have sex with her.... how is that different???
Whether it is legal or illegal, well who am I to say. But I know this, if we didn't buy porn, there would not be a porn industry. So society has only itself to blame. But what makes it worse is the hypocrisy. If a person ever bought, watched porn, what gives them the right to stand up and say it is immoral or that it should be illegal?

Well, I think it's because they get by on a loophole. Pornography is for entertainment purposes, and so just like art flicks that have people having sex in it, it can get by without being prosecuted under prostitution laws.
Our prostitution laws are pretty convoluted and mixed up.

In regard to Prostitution there is no federal law against it, it is a state by state issue whether Prostitution is legal or illegal, only state that allows the trade is NV and outside city limits, but all states could allow it if they deemed it

porno is art. porno is regulated and taxed. prostitution is not regulated and taxed. there are parts in the nation where prostitution is legal, and it has a two-fold effect. More people use the services, and the prostitutes are healther and more immune to the abuses of pimps.
It is a growth market ripe for exploitation, economically speaking. Go legallized hooker!

what you consider pornography, some people call "art'. To ban pornography teeters on trampling the First Amendment to the Constitution. Larry Flint has fought legal wars with the US Government over this issue. Look him up.
