Any party (a person or company) can draft a contract with another party and be bound by the terms of the contract.

In general, one does NOT need to be a lawyer to draft a contract, and some of the most famous contracts are literally written on the back of a napkin ("I will do xyz and you will pay me $abc. to do it.").

It depends if you are writing the contract as a legal representative, or as a friend or family member.

Technically, any signed written agreement between parties is a contract.
