it would not be a foul. the laws of the game state that The thrower may not touch the ball again until it has touched another player. as lond as you throw the ball at the opponent it would not be a foul. unless the ref is an idiot and doesn't know the rules.

As long as the throwing action was legal (Above head, proper release)
