you shouldn't sue the bank. filing with a consumer agency is basically your protection. i would also file LETTERS with the bank, its branch and its Headquarters if you can't get them to resolve it your way and you really really feel that you've done no wrong and they are completely at fault.
And, I would NEVER EVER do business with them again. you're the customer and you're always right. don't give them any more business!!
also, if they ever try to report you to anything, you have your letter to the agency. disputed items can't really harm you if you have proof that you've even disputing it in most cases.

Banks just post what are presented to them. MasterCard or Visa (whoever issued your debit card) or the merchant posted the transactions twice. Your bank is just a pass-thru entity, but they should help you get this resolved. You will need to write a letter stating that you only authorized these purchases once. If you're lucky your bank will give you provisional credit while waiting for those transactions to be reversed, yet they are legally under no obligation to.
My advice: use a credit card and pay the bill off every month. You get to hold on to your cash a little longer, it accomplishes the same function as the debit card, and you (the consumer) have more rights if things go bad. And be patient and polite. Nastiness will get you nowhere.

Six years ago, I had a problem with my bank, Fleet Norstar in Depew NY. I was getting married and I withdrew $60 out of the banks ATM machine. I then wrote a check and overdrew my account. I realized that I made this mistake almost right away. Before the bank did. I went to the bank to deposit the money I took out , so not to overdraw the account. When I went to the bank the computer system was down. I explained to the teller what happened, she called the branch manager over and he reassured me that that would take care of the problem for me. They took the money, gave me a receipt and told me that they would process the transaction when the system came back up. >>This was my last transaction with this bank. My husband to be and I were opening a joint account with his bank after we were married.>> The Friday evening before my wedding I got a call from a collection agency, wanting the $60. I explained that I had payed the bank the $60. I was told by the collection agent that my account would be sent into collection on Monday if I didn't repay the $60.00. I never have been threateded with collection before. I was nieve and young. I was leaving for my honeymoon on Monday so I payed him the money. I figured that I would go back to the bank when I got home. >>When I got home I went back to the bank. I had then receipts, proof that I had in good faith fixed my mistake. The Bank Manager treated me like a fool. He told me that it was bank policy not to give money back, and the best he could do was give me $25.00. I gave this bank $60. I was not going to settle for anything less. I was fuming. He treated me horribly. I left the bank. When I calmed down a bit, I called the bank back, and spoke to this MAN. After a frustrating few minutes I told him that I would take the bank to small claims court to get my money back. This MAN told me it would cost me money to file for the court and my time was worth more than taking them to court. I reassured him that I would get my brother who was an attorney and we would indeed be in court. He said "Lady, You do what you got to do" and hung up on me!!!!!!!!!!! How dare he treat me like a stupid, WOMAN! My husband then called this %#@. The manager gave him the money back!! Because he was a Man!! Well now I tell everyone who will listen about my bad experience with this bank, ( FLEET< NORSTAR Depew NY) including his boss, and his boss, and his boss!!! They no longer have my business, but they will get a bad reputation.

It wouldn't go to court. That banks lawyers wouldn't let it happen, they would settle. But first, I recommend that you go into the bank(being as polite as you can) and ask to speak to the main manager. Have all your papers there and present the problem. I am sure the manager will get is solved. More then likely, the manager doesn't want to screw u over so they'll probably work with ya. Good luck.

there are do it your self letters you can send initiating a legal action if you don't want to pay for a lawyer. Normally these things get taken care of with a letter threatening legal action.
Though if you go to the bank and talk to the supervisor of the idiot messing you over it will be handled also. There is always some twit that doesn't have a clue till you are sitting at their desk.

Go down to the bank in person and talk to an officer in person and don't leave until you get a resolution.
