Need to know the legal percentage that is required to be paid from my monthly salary to my spouse and two children. I currently pay £615 per month for mortgage and insurance from a monthly take home amount of £1,300.

I do not want to incurr solicitors costs for this question prior to informing my spouse that I cannot afford to pay the whole mortgage.

Also do I need to continue to pay 50% of the mortgage to protect my interest in the property?

I have been separated for just over a year but not divorced and are experiencing financial difficulties.

The amount of child support is determined by both parties income. As for the rest, there are many factors and the best advice is to get a lawyer and find out. Good luck.

Can a correct a few comments... the amount you pay for child maintenance is NOT depedant on your and 'her' salary... just yours. And also, as 25% is the amount you would pay from your salary (which is divided into weekly amounts which differ depending on how often you see your children... see them more - pay less etc) - details are on the CSA web site - there is also a calculator to help you assess how much you will have to pay.

Selling the house is the best idea but be aware that it may not be a 50/50 split as your wife (if she can prove) needs more to re-home her and the children, this may sway the portion - BUT, this does not mean you lose it, it would mean that you then have the amount from your half as a stake in her property which she would have to pay back at certain trigger times (ie when she re-marries etc)....
Seek a free initial legal session and you'll get to know more from there. they always advise to try and settle out of court as this will save you the most money.

hope this helps.

If you cannot pay the whole mortgage you should sell the place and move to a lower rent flat. Split the profits in the home and pay her off, as to the percentage of your salary that goes to Child support it is different in most cases and based on what the court decides. Selling the property will solve all your financial difficulties also.

If you are getting a divorce the best suggestion is to sell the house and split the profit on it. Then you will not have to worry about not being able to afford the mortgage. The amount of child support depends on how many children, what age they are, what state you live in and how much the judge feels is far without putting anyone into the poverty level.

Good luck!

Sell the house and try to split the profit but many factors enter into the equation - how long you have been married, each person's earning potential, pensions, etc).

If your wife gets the kids you should pay 325 pounds per month (25%) for 2 children reducing to 195 (15%) for one child. There could be reductions to that if you pay for additional school fees and the number of nights they spend at your place.
