if your children stay overnight at your x's a few nights a week do you have to declare this to the dss?

I have checked on the Child Benefit web site and the following seems appropriate:

"Children living away from home
Changes that happen to a child
You must tell us if a child:

has lived away from you for
more than 56 days in any 16 week period or
at least one day each week in the last 8 weeks and they are
being looked after by a local authority (in Northern Ireland, a Health and Social Services Board or Trust) or a voluntary organisation, or
detained in secure or non-secure accommodation,
leaves the UK temporarily for more than 12 weeks,
leaves the UK permanently, or for more than 52 weeks,
leaves
Great Britain (England, Scotland or Wales) to go to Northern Ireland permanently, or
Northern Ireland to go to Great Britain permanently.
has been in hospital or living away from home because of physical or mental illness for 12 weeks or more and you do not have to spend any money on them as a result.
You do not need to tell us about children away at boarding school in the UK who come home in the holidays"

So if your children are just staying overnight with their father there would not be any problem.

No but if he was giving you an income this would need to be declared as money coming in. If you have told the DSS that you are not with him and that he is not giving any money then I suggest you keep it that way or you will have the child support on the case and you wont be better off because what they get from him they take from you.

Nope .. but more than 4 nights i would tell them .... just to cover your back...you know what the Dss is like it they can save a few quid they will .

If the children stay more than a certain number of nights a year and he is paying child support via the CSA, then he can get his payments to you reduced.

Your child benefit won't change if their permanent address is with you, the only thing that it will possibly affect is the maintenance paid to you (this depends on how many nights in a year, roughly, they stay with your ex)

No you don't!!!!!!! This doesn't affect your benefits as you are still their main carer. But, saying that, how many nights a week do they stay? Is it more than 3?

no i dont think you should report it, unless you have the kids for less that four days a week, then you should report it. i think it is nice to let the kids go over but he shouldnt have to pay you if you dont have the kids, right?

no your buisness is yours if they live with u thats there permenant adress it goes to the full time parent x
