Yes he could be arrested for rape even if you conceded as minors aren't capable of always making wise choices. As for being emancipated I'm not sure but I think you have to prove that you can support yourself and not depend on society to support you. Even if you do your mom will still find out about the pregnancy and that is just the childishly way of thinking to keep out of trouble.

IT is illegal, but the good news is your parents have to press it. To be emancipated you have to have a good job. A place of your own picked out and proof you can pay your own bills without welfare and other things that I am not quite sure about. You also have the choice at 16 if both of your parents sign(being pregnant changes minds trust me)you can get married and that makes u legally ur own person as if you were 18. If your parents are against this you may have some trouble specially if they do not like the bf cause he can go to jail rather you said it was ok to have sex with him or not. So I would aproch this with your parents AFTER you know for sure that you are 100% pregnant. Good luck to you dear, and try to keep a cool head when talking to them is a very big key!

While Texas state law clearly states that sex with anyone under 17 is illegal, as long as the other person "was not more than three years older", had consent and was not forcing sex, and is not a sex offender, they have "an affirmative defense to prosecution"

"§ 21.11. INDECENCY WITH A CHILD. (a) A person commits an

(2) with intent to arouse or gratify the sexual desire
of any person:(A) exposes the person's anus or any part of the
person's genitals, knowing the child is present; or
(B) causes the child to expose the child's anus or any part of the child's genitals."
However, note that:
"It is an affirmative defense to prosecution under this section that the actor:
(1) was not more than three years older than the victim
and of the opposite sex;
(2) did not use duress, force, or a threat against the
victim at the time of the offense; and
(3) at the time of the offense:(A) was not required under Chapter 62, Code of Criminal Procedure, to register for life as a sex offender; or (B) was not a person who under Chapter 62 had a reportable conviction or adjudication for an offense under this section."

you should of thought about this before you got the big P, I don't know your mother so it's hard to tell you what to do, maybe she will be understanding, you didn't listen to her before and you know it or you won't be in the shape you are, It's easy not to get P if you would make your loving BF use rubbers, he didn't take care of you before so why do you think he will take care of you now, maybe if you trusted your mother more she might be willing to help, but if you disrespect her some more, maybe not.
