Ok, so the apartment I am living in is being remodeled. They first did my apartment, and now they are working on the upstairs and painting the outside. The upstairs is almost finished, it just needs water and a few doors to be hung. While they are working on the house, a worker is staying upstairs. The problem is that there is no water so he has to come outside and use the sink that is right outside my bedroom window. Not to mention that the toilet doesn't work, I dont know what he is doing with that... Is this legal? Occupying a house that does not have a working toliet or water? I'm trying to get him out because he creeps me out. I'm young and my husband is out to sea and this is my first time living alone. I do not feel safe with this man upstairs and I've already voiced this to my landloard and she did nothing... so I'm trying other options. I am moving out in 2 weeks but every night is very scary listening him walk down the stairs to use water in the middle of the night... HELP!!!

My apartment has water, its the one upstairs that does not have water yet. I guess a better way to ask this is does an apartment or house have to pass a certain inspection by the health department or someone who issues building permits before a palce can be occupied. I remember my when my parents were building their house, a building inspector had to pass the house before it could be lived in. But that was in Maine and now I'm in Hawaii so the laws are probably different.

Call the police. They can better answer as laws change from place to place. Here that would be illegal.

If the apartment you are renting has no running water, then your landlord may have breached the implied warranty of habitability which corresponds to most residential leases. The implied warranty of habitability refers to the duty of your landlord to provide you with residential property which is fit for human habitation. If there is a fundamental problem with the premises to the extent you cannot occupy the dwelling, such as perhaps a lack of running water, then you may be entitled to certain remedies, such as terminating the lease and moving out, a reduction in rent, damages from the landlord, etc. You should consult an attorney familiar with landlord-tenant law in your area, as your landlord's failure to provide some basic necessities of life may make them liable for the damages you've incurred.

On the other hand, there's not much you can do about a creepy employee or independent contractor which your landlord hires. The security guard at my apartment complex creeps me out to no end.

It's not legal to stop your water without notice. I dont know how long they can leave the ater off but I"m sure the water department would know the laws regarding that in yoiur state. Since you're lucky enough to be moving in two weeks, unless you're planning on suing "legal" doesn't matter since the landlord could care less if you say "that's illegal"

there is nothing you can do the owner has to provide accomidations such as hotel or other if agreed by worker it does not matter if he sleeps on youre front porch the OWNER owns the property not u. you pay rent for youre place not the great out doors. onless the area you rent u have control on (locks )for gates surrounding house Apt . or other. also u did not have a problem when you where first to re model ? right . mind youre own biz and wait for hubbie. are u on base housing ? u leave out to many details. i bet ur place works fine. looks fine too. navy people have M.P.s @the gate so the worker must be ok quit trippin and make him lunch!!!

i am sorry but unless he is getting naked or going to the bathroom outside he is not doing anything wrong. and yes you can live in a apt, that does not have flowing water.

call your local health dept. they might be able to do something about it but i am not sure good luck
