People do swear on a Bible in court today in many jurisdictions. However the person being sworn in for testimony is given the option of swearing or affirming. If the swear the oath is usually something like: Do you swear to tell the truth, the whole truth and nothing but the truth, so help you god. If the affirm the word affirm is substituted for swear and the so help you god portion is left off. Some courts do this with out a Bible

But the issue of whether or not an atheist can swear on a Bible in court is another matter. Of course they can. They can swear or affirm just like anyone else. The swearing or the taking of an oath before god is an anachronism that comes from a day and age when people believed that god would punish them if they lied under oat. (I suppose it was alright to lie if you didn't take an oath but just lied). Therefore the tasking of an oath was more certain to bring about truth telling in the minds of ancient peoples. But consider this: if a Person who is going to lie is an athiest or a Christian or a Moslum or any other kind of believer, will it really matter if he is a lier when he or she takes the oath. In other words it really makes no difference. You are either going to tell the truth or you are going to lie, so being an athiest is totally irrelevant and no judge would care in the slightest what your beliefs were. Just don't lie. That is all that counts.

no one swears on bibles anymore, that is only in the movies.

people affirm that they will tell the truth. No bibles involved.

They could, but it wouldn't do much good. How is swearing on a book they don't believe in going to keep them from lying?

Of course they can, it's the courts fault if they feel no remorse if they lie :D
