No, the tenth amendment leaves anything not covered already, to the states or the people. Since the people have to vote on the ratification of any added amendments, they are all constitutional.

A constitutional amendment cannot be fraudulent, because they are not misrepresentations of fact which others might reasonably rely upon and thereby suffer injury. The constitution is the law of the land, and the most powerful legal document we recognize as a nation. The amendments dictate the law, rather than abide by any other.

Before any additional ammendments can be added to the Constitution they must be:

1. Approved by 2/3 of both houses of congress.
2. Ratified by 3/4 of the legislatures of the states, usually within a 7 year time period.

This meets the requirement for approval by the states and citizens.
