her father is collecting and i dont get child support from him. so i was wondering if she got his benefits from ssi

If he receives SSDI, which is Social Security Disability Income for which the person has worked to earn credits, your daughter would be eligible to receive benefits based on his record.

Since he receives SSI, which is Supplemental Security income, she is not eligible to receive benefits based on his record. SSI is a type of welfare for those who are disabled and who have not worked long enough to qualify for SSDI.

NO - SSI is not the same thing as Social Security Disability. A child can not get survivor's benefits from the SSI program. Survivor's benefits come from the Social Security Disability Insurance Program.

Also, child support can not be garnished from SSI benefits.

No you cannot. And because his income is base on income from the government ( it depends on the state in which you live) you cannot get child support from him. And also you cannot recieve SSI for you child unless she a a illness that can be life threatening, or she is disable (mental retardation, ADHD, Autism, etc) Lost limb (arm, legs etc.) Also you must have proof of it and show that you have been taking her to the doctor for over a year for those problems.

Im not sure of the particulars, but if he's recieving SSI for himself she should get a check as well.. because i had a friend years ago that her husband was considered disable and im 99% sure she had mentioned something about the kids recieving SSI as well because of him being disabled.. Definately call the SSI office and find out for sure..

You can call your local social services and find out........ But when My dad was on SSI he was court ordered to pay a whopping 125/month in child support for 3 kids!! so even if you get something it may not be much!

YES my husband does collect and we Will be receiving for Our children also... Contact a Lawyer because if he is Not paying child support the Money he receives will go to her first including the monthly she will be getting... I wish you both All the Best...

Depends on your state laws. You'd probably need to get involved w/social services to obtain any benefits.

i can answer this absolutely unequivocally the answer is no. she cannot collect off of him and you cant receive child support. sorry but at least now you know the answer.
