Are mutants really a different species? (Homo superior vs homo sapien)?

The different species answer fails at one major test: they can produce fertile offspring w/ homo sapiens.

So, if they are a different species, then you could argue that laws for humans don't apply to them.

If they are homo sapiens, then it would seem such laws violate principles in the Constition.

It would also be logistically challenging to register them all. And what if you're a mutant like Cipher? Big whoop, if it weren't for Xavier people wouldn't even know he was a mutant.

And what about the people "mutated" by radiation (Spiderman, Fantastic Four, Daredevil) or biotech (Capt America)...do they register even though they weren't born mutants? What about their rights?

There should not be a mutant registration act in X-Men because it would be like having people register with the government because of their race, creed or sexual identity. Then, there is the fact that the Marvel Universe politicians say they should register because they have powers which could adversely affect the other citizens but they were born with those powers and did not choose them. Thus, if the law was passed, we should have anybody which have a power register. And that is what is happening now in Marvel's Civil War series...

There shouldn't be one because
1.)how would you know if some one was a mutant?
2.) There are to many mutants.
3.) Mutants are humans too.
