First, it depends on the courts definition of how severe the mental disability of this person is.If this person is no longer capable of taking care of themselve therefore is no longer responsible for their action, then they cannot be charged, but if this persons level is minimum and know what they are fully doing, then yes. Depends all on the degree of mental disability
