These are illegal combatants, and could (and probably should) have been summarily executed, which is well within the US rights. They are not protected by the Geneva or Hague conventions, as they are not signatories, and they violate all the rules of being legal combatants.
They have no legal standing. And have no right to trial. As for any Americans there, they need to be tried and executed. The rest can rot there for eternity.

"Club Gitmo" is in direct violation of not only US treaties (which have the full effect of law), but also the 5th and 6th Amendments to the Constitution. The actions of our government directly violate constitutional requirements that have been in place for most of a century, and stand in direct opposition to everything this country stands for.
The 5th Amendment guarantees Due Process, and presentation of charges to a grand jury. The 6th Amendment guarantees a public speedy trial, the right to counsel, and the right to confront witnesses. None of these were being provided by the US government. Article I of the Constitution guarantees access to the federal courts through Habeas Corpus. These are not rights granted to US citizens. These are limitations imposed by the Constitution on the US government and apply to ANYONE in its custody.
Whether some of the people imprisoned there are guilty or not isn't the issue. The US government has not complied with its constitutional requirements. There has been no grand jury, no access to the courts, years before access to counsel.
The fact that the US government refuses to abide by its own laws makes them no better than the terrorists they claim to be fighting. That's what the big deal is.

In America we used to stand for a little thing called JUSTICE.
Keeping human beings locked up, with no verifiable proof to hold them on, is not justice. And if you think they are only holding people they captured out in Afganistan or Iraq there, think again. They have "arrested" American citizens, on American ground (in Chicago in the instance I am remembering).
This doesn't even include any discussion of alleged torture or mistreatment. Just being removed from your life, friends and family for 5+ years, with no hope of freedom, is bad enough, no matter where you are. You could put me in a 5 star hotel in paradise, but if I am unable to leave and unable to contact my family, it is still hell. And Gitmo is far from a 1 star hotel and definately not in a paradise.
Just because worse things have been done does not make it right to continue to do horrible things.

Because we are a law abiding society. It would be nice if we DID abide by our own laws and international laws (of which we were a major influencing factor in writing).
The ACLU is merely a guardian of the Constitution, always alert and watching for violations of this document and prepared to act to defend it ... and those it protects.
