She's 16 1/2 years old, and her mother (who lives in the U.S.) took my daughter to Mexico for vacation and they decided to just move there. I live in Texas (where we all used to reside) - just wondering how the Atty General will figure what to do with child support now?

As a member of the legal profession, let me offer my opinion. First, look at your Divorce Decree. Does it state that neither of you can move your child out of a certain zone (50 miles, etc.) without getting prior approval from the court? If it does, I would hire an attorney and file contempt papers immediately. Also, you should be able to file for a change of custody. I'm not guaranteeing that a court would change custody, but judges usually don't take kindly to a parent running off with a child even if that parent is the custodial parent. If you are missing visitation, you can file a Petition for Contempt and and Order to Show Cause where she has to appear before a judge. You should continue to pay your child support as you always do. Remember, you need to present yourself as the more stable parent. Plus, child support is not something that can be voluntarily suspended by anyone except a judge.

I would not send any money. If she moved your daughter out of state without your permission, (that is if you both shared custody) then go to the police and file a kidnapping. Because I find it hard to believe that a 16-1/2 year old girl would prefer Mexico to the US. I'am from Texas also this happened to a friend of mine. If she wants the money after you filed,she will have to re-enter the state and when she does they can arrest her. Talk to a lawyer, they will usually talk to you for free, the first visit ot KSTA in San Antonio (210)-599-5555 at 10:00am on Tuesdays or Wednesdays, has a lawyer you can ask free qustions to.

Suzy W is right, read your divorce decree, visitation schedule. If you do not have it or can't find it, go to the courthouse and with proper ID you can view it for free or pay for another copy. I think it is standard for a claus like that to be in your paperwork, it is in mine and also on the blank form you fill out in the beginning. I guess that is not answering your question if you are OK with the move. Don't worry, the state will figure it out about child support, they aren't gonna let you not pay. At least you only have a year and a half left to pay.

Sorry, your on the hook for child support no matter where she lives, but I do think she did have to have your permission to move out of the US. That is not necessarily true just moving to a different state. Any chance your daughter would prefer living with you? Then you'd be the one asking for child support.

What do the custody orders state? Does your ex wife have full custody or joint custody with you? If she has full custody she can move herself and daughter to the moon without your permission. The best way to pay child support is through the court system...don't worry they'll make sure your ex receives it.

do you have joint or partial custody? If so then she CAN NOT move to mexico without your permission, and even if you give permission, You do NOT have to pay child support if she moves out of the state that the child support order was ordered in!!

Who has custedy of your daughter? If your wife took her to mexico without your permition, you should get her for kidnaping. Both parrents have the say about wat a child under the age of 18 in the state of tex can go and do. If you didnot know wat your wife was upto, then you have a case , Contact the states Atty General office. Good Luck.

Make an agreement with the ex-wife, that you're just going to send the money to her. Make sure that you have proof of every payment. If you both go to the court and tell them that you have another arrangement , they will step aside and let you deal with it amongst yourselves. But like I said, make sure you keep proof of EVERY payment until that girl is 18.

u can send money over there for her to take care of your daughter but i do not think that can get u for child support if she is in mexico . i know i am married to a hispanic guy that is from puebla mx . and yes u can send money over there .
