Why have Democrats fought hard to keep Tom Delay on the ballot in Texas? Answer: To disenfranchise voters.

Now we know, "…let every vote count," actually means only when it benefits Democrats.

For those who are unaware, Democrats sued to keep Tom Delay on the ballot in Texas after he resigned his office and announced he would not run for re-election. It could be that they just want Delay to stay in congress, but I doubt it. It's more likely that they wish to confuse and disenfranchise voters by keeping Delay on the ballot even though he isn't running.


Democrats had hoped to wrest the conservative district from him. But DeLay seemed to thwart those designs in April, when he announced that he would resign from Congress and move his official residence to Alexandria from his suburban Houston district, making him ineligible to run for reelection.
Texas Democrats sued to keep him on the ballot, maintaining that state election laws say victors in a party primary must appear on the general election ballot unless they die or live outside the district on Election Day. They pointed out that DeLay still owns a Houston area home, where his wife, Christine, lives and where he still spends time.

Actually it is very simple.

he still lives in Texas and the will of the people in the primaries.

there is actually a very funny story of reporters going to interview him at his home in Texas after he claimed he moved to Virgina ........that man is just too funny.

Judge Sparks, appointed by the first President Bush, ruled that although Mr. DeLay was free to withdraw, the Republicans might not remove his name from the ballot, because the Constitution's sole residency requirement for the House was that a candidate "when elected, be an inhabitant of that state in which he shall be chosen."
No one could yet say where Mr. DeLay would be living on Nov. 7, the judge said. To allow such a ballot change would give Democrats an illegal disadvantage, he added.

"Political acumen, strategy and manufactured evidence, even combined with a sound policy in mind, cannot override the Constitution," Judge Sparks wrote.

He cast doubt on Republican evidence, noting that Mr. DeLay sent a draft of his letter announcing his move to Ms. Benkiser for editing.

Texas law prohibits the replacement of names on the ballot except under narrow circumstances to prevent parties from seeking advantages by suddenly switching candidates

Delay had the opportunity to step aside in the Spring and allow voters from his district to hold a special election and appoint someone else to finish his term. However, the Repubs were aware that it would be likely for a Democrat to win that special election (considering all of his alledged and shady actions were very prominent in the news);thereby giving the Dems another seat in the House and have a strong chance to hold it in the November election.
By Delay not withdrawing until after the primaries, he hoped to keep the seat unoccupied or appont a candidate of his choosing knowing all along he would not run in Texas for reelection. It's not Dems that are forcing him to stay on the ballot, it's Texas state law.

He won the primary. To bad if you don't want him dividing the conservative vote. He lives in texas and won the freaking primary. If he was going to pull out of the race he should have done it before then.
