I agree speeding is against the law, and fleeing from the scene, but they would be able to argue it in court because the first question would be: Why was the dog in the street anyway? Woudnt that be animal endangerment or something?

Not in America. In Mexico it is. When I was in High School I had a couple of friends who hit a dog, at night on a deserted road and the next morning the Mexican police were at their campsite to arrest them. They lost their truck, their camping equipment and were barred from ever going to Mexico again.

Actually yes it is, depending on what state you are in. Dogs are generally classified as companion animals and as such have greater protection than wild animals.
