In mature relationships, no. People go out and kiss strangers all the time. Hell, I'd have a great number of boyfriends right now if that were true.
But if you're in grade school, well... the rules are different because kiddies don't really understand relationships.
It is basically something which is agreed upon by both people, whether or not they are dating.

Nope - has to happened more than 27 times, then according to the law they are BF/GF. Until its happened 27 times they are legally not BF/GF.
