This is going to be at a show cause hearing for non-payment of child support, total amount due is just under $7,000. The total arrearage amount is around $6,000. If this person is arrested is it a misdemeanor on their record? How quickly can they be bailed out of jail? I'm hoping that its not immediate because this may be the thing this person needs to see that this is NOT something they have a choice in, but a responsibility.

Hi,

Failure to pay child support in Michigan is a felony (up to 4 years in prison depending on his record), and there is no defense if you were served with the order of support. How quickly they can be bailed out will depend on a lot of things. Were they extradited from another state? If so, bail will be HIGH. Bond is usually set at arraignment. If the jail is overcrowded, it is even possible the jail will release him early and give him a personal recognance bond. Have his ask the prosecutor's office about an amnesty program (some have them). If he can pay a big chunk, and go into agreement on regular payments for the remainder, they will usually forego arresting and pursuing charges unless he violates the agreement. If he can somehow come up with all of it, a deal can usually be worked out to dismiss the charges.

It is a misdemeanor and it will go on their record. Usually a person can be bonded out in ANY state within 48 hours, IF their initial bond hearing doesn't revoke the possibility of bail.

Immediately after the judge sets bail. People are entitled to speedy trials in the United States.

They might put him on work release until he gets caught up on the debt or if he has the money he can get out right away, and i think its just a misdemeanor.They are Really cracking down on dead beat parents in Michigan.Macomb county resident.
