Smoking is not a right or a necessity. Eating is a necessity. Alcohol isn't illegal but you can't just drink it anywhere.

I HATE smoke. Wish they'd ban it where I live.

I am a non-smoker and I not only hate cigarettes, but they actually make me sick because I have asthma.

However, I do think it should be up to individual businesses to decide whether or not they will allow smoking in their place of business. I think they should also be required to post a notice in a visible place on the outside of the building to warn people like myself to stay away. I've worked in restaurants for years and I disagree with your statement which says 99.9% of people in restaurants smoke. When I lived in the south, I worked in a restaurant with a smoking and non-smoking section. The non-smoking section was always full.

As for public parks, etc..... maybe if smokers in general were more responsible about their litter, it wouldn't be such an issue. Earth is not your ashtray. All those toxic filters wind up in our water supply eventually. If you want to pollute yourself, fine. Leave the rest of us out of it. An overweight person eating fast food is only affecting his or her own health.

The state I live in passed the no-smoking law last year, and tips only suffered for a little while. People will eventually get used to the new law and will go back to the bars once again.

It's always been smoke free in places like hospitals, most offices or workplaces, etc. but a few years ago they made a law where you cannot smoke within 50 feet of any public building (City Hall, libraries, schools, etc.) It's not too bad. It's the restaurants (also a ban on smoking there) that annoy me. There is nothing like a cigarette after coffee and dessert. I don't like eating out anymore.

The state I live in has enforced the no smoking ban in public places, I smoke but it has not been a problem. I don't believe in smoking around others who don't or children anyway. It really is a good law as some smokers are not very considerate of others around them.

I am a non-smoker and I have to agree with you. It is not fair and yes July 21st, it will be official all across Arkansas NO SMOKING!
I don't think it is fair to the smokers. I have a very bad lung disease, my husband smokes outside. But he has been doing great at quitting. It is hard to quit when you have smoked for a long time. My husbands place of employment has hired someone
to come to the plant every Friday for 6 weeks to help smokers quit. They are even paying for the prescription 100%. I am very
proud of my husband. Last week was their first week, and on
Friday, my husband was the only one that could say "I have not had a cigarette in 3 days!" He was applauded for his commitment
He knows he can't smoke around me because of my health &
my oxygen use and he is trying his best. And I am very very proud of him.
I am going to post a question after having read this!

Here in Washigton they jsut past a law that says tyou can smoke in any indoor public place. It is a crock of CRAP! My customers have to go outside now and my tips suck because of it!! I have friedns that are loosing big money at the bars that they own because customers don't go in anymore because they cant smoke while they drink. MAke it a choice. I a non smoker does not want to go in to a place where there is smoking, then they don't ahve to. But because a few of these whinny wimps cried out the lae has to be changed,.

I was an on/off smoker until I moved to San Diego, mostly because in WA I would go out with my friends and have some drinks and end up smoking because I smelled it and wanted it.That is pretty common, so when I moved, the temptation was for the most part removed and I haven't had a smoke in over 4 years. As for business, people won't stop going out to eat just because they can't smoke. They will compensate. And as for discrimination, bullcrap, smoking kills just like drunk driving. When that became against the law, did the people who prefer to drive drunk yell discrimination?

I kinda agree with you but its just a health precaution for others who dont smoke.

Putting a sign on a building that says "people smoke here" ruins business.

Its unfair to people who are allergic to smoke, have severe asmath or just cant stand the smell to have to work around someone elses bad habit.

Its not like being fat, crippled, blind, wearing glassess at all. Smoking is completely optional.

[now you may say so is being fat.. but that has been proven to have been biological in some cases and thats often uncontrollable.]

I don't know how anybody can state that the rights of someone who pollutes the air and endangers my life with cigarette smoke supercedes the rights of a non-smoker simply because of their pleasure.

Even if you set aside the health dangers of smoking, what about the irritation and the smell? How would you like it if I walked up to you in a restaurant and threw a glass of water in your face? Sure, you would be wet and a little annoyed! But what does that matter? I enjoyed it! If you don't like it you can go somewhere else!

you are right and wrong. i used to live in california where it is illegal to smoke in or near any public place. it is done for the health of the greater public. seconhand smoke is way more deadly than smoking a cig because it is unfiltered smoke. and guess who gets to pay the medical bills of all those people who suffer secondhand smoke effects? that's right--taxpayers. so while yes it is a form of discrimination it is seen as a necessary one for the health of tens of millions of people who do not smoke.
to your other points: fast food places are required to provide a list of ingredients and nutriotion information. machinery operators are subject to osha standards.
the difference is that fat people don't cause other people to be unhealthy by virtue of being fat. and a vision impaired person would not be allowed to operate machinery if it was deemed his glasses made it a danger for him to use it (think pilots). but smokers make other people unhealthy by filling the air w/ secondhand smoke. non-smokers have a right to breathe clean air.
