My company is fullfilling a contract by producing an informational CD for a company that consults others on disability access. We are using photos that our client took to illustrate the do's and don'ts of proper access for people with disabilities. In some of the photos that show improper access, the businesses are identified by their signage. Could those business take action against us or our clients for libel or other cause?

I would also be sure that they do not follow the LETTER of the ADA not just the spirit.

Truth is a defense for libel or slander in the U.S., so as long as the photo isn't misleading, I don't see a problem. The only possible concern would be if the offending business has since corrected the problem, then claims that the photos are no longer correct. I suspect if there is a copyright or production date shown, this would handle that because you could say that your CD only shows that they were violating the law as of that date, and you're not trying to imply that the business is still in violation. Or perhaps you could even put a statement at the end of the CD stating this.

no beacuase they were true. libel has to be false
