Let's focus on how you paid your rent. Did you pay cash or by check. If you paid by personal check you have a receipt that shows payment, date, and who you paid. Now was the check cashed? If so all you need to do is get a copy of this from the bank. Now create a paper trail. Perhaps you've been consistent and paid by check for 3 months. Now it's hard to prove that an oral agreement was made but if the person accepts payment for something and you can show a paper trail that this person has been accepting payment then you have evidence that this person is accepting payment for rent regardless of oral or written agreement.

First of all get receipts for all rent that you have paid and continue to pay. Make sure the receipts clearly states the amount...and what the payment is for. Next, get a signed statement from the person whose name is on the lease that you are the one who has been and are paying this money. If they object, (I don't know why they would) explain that it is protection for you in case for any reason you are sued or not given credit for which you are rightly due.

An oral agreement is worthless. Unless you have a reciept, you're in trouble. However, if your name isn't on the lease, then you are not legally responsible.

Get it in writing, or have witnesses to the oral agreement. The oral agreement may not be enforceable no matter what, depending upon your state laws.

ask whomever you have the oral agreement with to write a statement saying you pay x amount of rent. And have it notorized

Attempt to go to the landlord, ask them for the historical ledger of payments made on your lease and ask them if they keep copies of how the payments are made (cash, check, cashier's check). Most large property management companies can tell you who paid the rent and when.

Also, I would contact whoever owns your house/apartment and have them draw up a contract with a lawyer. You can tell them that this way they will be protected if something ever happened to where you are living and you can't sue them, or vice versa. Good luck!!
