He is going to get 5,000.00 per month for the next six months on a deal he made with the owners of our business, as well as they will pay off his debts. I know if I take him to court he will tell the judge he is unemployed. What should I do? Should I start the proceedings anyway and go at it alone?

If you have proof of this you can retain an attorney without putting out of your own pocket right away, int can be included in the settlement.
Find a lawyer who specializes in these matters, there are planty of them.
If you cannot prove this deal your ex made, then subpeona the people he made the deal with, if this happens the money you are supposed to be getting will probably show up before you have to go to court. A little fear in of a legal matter is a fantastic motivator.

Try to find some records of any dealings of his income. Does he need to claim it with the IRS or is it under the table? Try and record him with a camera or voice. Contact the court and ask what you should do in this situation. Tell them that you cannot afford an attorney. Also there are women support groups that provide legal advice for free and sometimes may represent you. Make sure you have evidence, and plenty of it, not matter how trival you may think it is and get it all together (don't let him know what you are doing) then do it alone if that is your last choice. But after the six months he won't have any income? You also have to weigh the situation, is it worth 6,000?

You need to do some research in your area and find the district attorneys office in your city. They usually have a department that handles things like this. What you think he is going to do is called fraud.Also there are always low or no cost legal aid services available. You said the business was "ours" so that may give you a lot more power if your name is on any of the paper work. Just make sure you take all the paper work you can get your hands on regarding the business including tax forms. It will make their job that much easier. Good luck and kick the rat to the curb.

If you have proof that he is getting this money, it may be in your best intrest to fight. Most attorneys will take payments even small ones. I was awarded $27 a month in child support and I didn't fight for 9 years and later he took me to court to try and take the 14 year old from me, and I had to. Then I pulled out all stops and kicked his butt. He's not a good guy or someone you loved...he's a stranger now. You have to do what you feel is right for you.

As long as you have proof that he is getting money then he needs to pay. He can't hid 5000 he will have to pay taxes and get a check so the judge will be able to see that he has money to pay you. Also if he's suppose to give you money from this settlement and that is part of the settlement prove that too and the judge will have to make him follow that.

I have no idea what to tell you al I can say is Good Luck ...ex's can be difficult at times. Try getting a lawyer that is willing to take payments from you maybe on a monthly basis. You will have to call around but I am sure that someone will be willing to help you

If he is still your husband legally, you could stay and get your share of the $5,000 month.
Talk to a lawyer. They frequently do not charge for a consult. You could very well be entitled to a portion of future payments.

Get copies of the settlement and then go to court. Also make copies of any bank statements and take pictures of all assets. He'll try to weasle out of everything, you need documentation on your side. Also you can subpeona the owners of your business to testify that they are indeed making such payments to him.

check into the dollar limits for small claims court. it may be limited to $1,000. If that's the case then you wouldn't need a lawyer, just proof of the fact that he is receiving the money. The courts can order him to pay it. employed or not.

Do you have documentation which states the deal he has with the owners of your business? If you do have documentation that outlines the details of the arrangement you could proceed with the courts. It's always best if you have written proof. Best of luck.
