Actually the snake was more than likely found outside the Garden Of Eden. When the serpent (which had legs) was abolished by God it was then doomed to crawl on it's belly for the rest of time. Which was outside the Garden.

Some of the oldest that I know of were found in Israel, they've even found some with legs. Serious.
