i need to know if everyone has the right to ask for the case to continued if this is the first court date set. do I have the chanse for 30 more days or do they have the tral right then

When one is arraigned in court, for minor offenses the court will schedule a trial down the road a period of time. That period of time varies depending on the availability of witnesses, the complexity of the case, and the Court's docket.

Continuing the matter is purely at the discretion of the court. Everyone has the right to ASK for a continuance. However, there is no automatic right to have that continuance granted. If you can show the court a good cause to grant it, then it will most likely do so.

If you are foolish enough to be representing yourself, then you should contact the prosecuting attorney prior to making the request for the continuance, to see if they object. Then, make the request for a continuance BEFORE the date set for the trial. If you go into court on the day set for trial, and all the State's witnesses are there, it is unlikely they will grant a continunace.

For more specific help, you should talk to an attorney. If this is anything more serious than a traffic ticket, then do not play with your future. Get a lawyer.
