to recieve paymengt because I had to wait until the company i worked for was paid by its client. I picked up 3 checks that the cimpany owed me and went straight to a check cashing place and cashed the checks so i didn't have to wait in fear for them to be returned. i had reason to beilveive the company had financial problems. The checks were returned by the companys bank, the cc place called me. i gave them the name & # of the guy who hire me for the work, they left msg, they called me back, i did the best I could to help them reach him (he was not responding to my calls either) THEN his # changed and he moved from the small office he was working from in Marina del rey. NOW THE CC PLACE has mailed ME a copy of his returned check & is demanding I pay them or they will take me to court. they are writing me letters, making it sound like i wrote them a bad check! Does anyone know how I should proceed? i am doing some research, but If someone has any certain knowledge, PLEASE ANSWER MY ?TH

Unfortunately, you're responsible to the place you cashed the check...and tha place that gave you the check is responsible to you.

Chances are that when you cashed the check you signed an agreement accepting responsibility for the checks in case of default. The only thing you accomplished when you went to a check cashing place was costing yourself more money. They will now charge you much more in fees then your bank would have ever dreamed of. it is a very unfortunate situation that you are in at this point. the one thing that you have going for you is the fact that drawing and passing bad check is criminal activity and you should be able to file charges and have the courts collect your money. Most likely you will get it back eventually, but it’s going to cost you up front. Good luck.

You should pay back the check cashing place as soon as possible. You have their money. You should then deal with the company that wrote you the bad chacks. Small claims court may be a good start, or you may want to hire a lawyer.

Wow! That's a tough one. You do place some risk when doing a check where money had not been actually claimed. Did you read any disclaimers the CC place had? Does it state that you are liable? You may need to look at the paper work. :o)
